responds to copyright infringement claims under the U.S. Digital Millennium Copyright Act (DMCA),
the Indian Copyright Act, 1957, and applicable international frameworks (including the Berne Convention
and WIPO treaties). We respect intellectual property rights and expect the same from users and partners.
Scope of Content at Xperiserv
- We primarily publish content created by our team (e.g., website text, designs, documentation, marketing assets).
- Client Projects: We deliver services and projects for clients under contract. We do not upload or host client content on our public website unless expressly authorized.
- If any copyrighted work appears on our website in a way that you believe constitutes infringement, you may submit a notice as described below.
Before Submitting a Copyright Complaint
- Verify you are the copyright owner or authorized to act for the owner.
- Identify the exact material (URL(s), screenshots, and a clear description) you believe is infringing.
- Consider whether the use is permitted under applicable law (e.g., fair use/dealing, quotation, criticism, review, news reporting, teaching, scholarship, research, parody, or incidental inclusion).
- If your claim concerns a client project referenced on our site, confirm that the allegedly infringing material is actually hosted or controlled by us.
How to Send a DMCA/Copyright Notice (Takedown Request)
To request removal or restriction of allegedly infringing material, send a written notice containing the following:
- Your full name, mailing address, and an email address for response.
- Identification of the copyrighted work(s) you claim is infringed (list all relevant titles, registrations, or descriptive details).
- Identification of the material you claim is infringing and its location on our site (full URL(s)).
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
- Your physical or electronic signature (typing your full legal name is acceptable for electronic notices).

Incomplete notices may be delayed or rejected. We may share your notice (including contact details) with the poster or other parties as needed to investigate and resolve the claim.
What Happens After We Receive a Valid Notice
- We will acknowledge receipt and review the claim.
- We may temporarily remove or restrict access to the material while we investigate.
- We may notify the affected party and provide a copy of your notice.
- If appropriate, we will remove or disable the content and, where feasible, take reasonable steps to prevent repeat infringements.
Counter-Notification (If You Believe a Removal Was in Error)
If your material was removed or restricted and you believe this was a mistake or misidentification, you may submit a counter-notification including:
- Your full name, mailing address, and email address.
- Identification of the material that was removed or disabled and the location (URL) before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your consent to the jurisdiction of the courts described in the “Governing Law & Jurisdiction” section below, and that you will accept service of process from the original complainant (or their agent).
- Your physical or electronic signature (typing your full legal name is acceptable for electronic notices).

Upon receipt of a valid counter-notification, we may restore the material unless the original complainant informs us that they have filed a court action seeking to restrain the allegedly infringing activity.
Repeat Infringers & Policy Enforcement
Where applicable, we may terminate or restrict access for users or partners who are determined to be repeat infringers. We may also remove content at our discretion to comply with applicable law.
Non-Client Hosting Clarification
Xperiserv does not upload or publicly host client-owned content on our website unless explicitly authorized.
If allegedly infringing content relates to a client project that is not hosted by us, please direct claims to the relevant hosting party or platform.
Governing Law & Jurisdiction
This policy is intended for international application and references multiple legal frameworks (including DMCA (U.S.), the Indian Copyright Act, and applicable international treaties).
For any disputes with Xperiserv arising out of or relating to this policy or copyright claims concerning content we host/control,
the exclusive jurisdiction and venue shall be the courts of Cuttack, Odisha, India.
Changes & Amendments
We may update this policy from time to time. Changes are effective when posted on this page with the “Last updated” date. Continued use of our website after changes means you accept the updated policy.
